Terms & Conditions

These Terms and Conditions (“Terms”) govern the use of services provided by Watts The Load LLC (“Company,” “we,” “us,” or “our”). By booking services, submitting payment, or using our equipment, you (“Customer”) agree to be bound by these Terms.

1. Services

Watts The Load LLC provides dump trailer rental, hauling, material delivery, and related services. All services are subject to availability and acceptance by the Company.

2. Booking and Payment

All bookings require payment, deposit, or reservation fee as determined by the Company. Prices are based on the agreed rental period and services selected. Payment constitutes acceptance of these Terms and all related policies.

3. Delivery, Placement, and Pickup

Delivery, placement, unloading, pickup, and return of trailers are governed by the Company’s Delivery & Placement Policy. Customer acknowledges responsibility for site conditions and accepts all risks associated with trailer placement and material unloading performed at Customer’s direction.

4. Customer Responsibilities

Customer agrees to:

Use the trailer safely, lawfully, and within stated load limits
Ensure proper towing capability if picking up the trailer
Secure all loads during transport
Prevent damage, theft, or misuse of the trailer
Allow only authorized users to operate or tow the trailer

Customer assumes full responsibility for the trailer during the rental period.

5. Prohibited Use

The trailer may not be used for prohibited materials, overloading, unlawful activities, or in a negligent or unsafe manner. The Company reserves the right to refuse service or terminate the rental for violations of this section without refund.

6. Inspection and Condition

Customer is responsible for inspecting the trailer prior to use. Failure to report existing damage constitutes acceptance of the trailer in good condition. Customer is responsible for returning the trailer in the same condition, ordinary wear and tear excepted.

7. Late Returns and Additional Fees

Late returns, damage, excessive cleaning, disposal fees, or unauthorized use may result in additional charges. Fees are due immediately and may be charged to the payment method on file.

8. Refunds and Cancellations

All refunds, cancellations, and deposits are governed by the Company’s Refund Policy. Early returns do not qualify for partial refunds.

9. Damage and Liability

Customer is responsible for any loss or damage to the trailer during the rental period, including theft, vandalism, or misuse. Customer agrees to reimburse the Company for repair or replacement costs, including loss of rental income.

10. Limitation of Liability

To the fullest extent permitted by law, Watts The Load LLC shall not be liable for indirect, incidental, or consequential damages, including property damage or personal injury arising from the use of the trailer or services, except where caused by gross negligence or willful misconduct.

11. Indemnification

Customer agrees to indemnify and hold harmless Watts The Load LLC from any claims, damages, losses, liabilities, or expenses arising from Customer’s use of the trailer or services.

12. Force Majeure

The Company shall not be liable for delays or failure to perform due to events beyond its reasonable control, including weather, equipment failure, road conditions, or acts of God.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas.

14. Modifications

Watts The Load LLC reserves the right to modify these Terms at any time. The Terms in effect at the time of booking shall apply.

15. Acceptance

Use of the Company’s services, equipment, or website constitutes Customer’s acknowledgment and acceptance of these Terms and all related policies.
